This new policy was announced in a January 6, 2004 memorandum for the heads of executive departments and agencies from Andrew H. Card, Jr., Assistant to the President and White House Chief of Staff. http://www.usoge.gov/pages/whats_new/whats_new_temp/wh_208b1_04.pdf In addition, the heads of executive departments and agencies are directed in the memorandum to examine existing delegations of the authority to grant such waivers, to ensure that officials at an appropriate level of seniority and responsibility are involved in the decision making process. In accordance with section 301(d) of Executive Order 12674, when practicable agency personnel must consult with the Office of Government Ethics (OGE) before granting these waivers or any other waivers under 18 U.S.C. 208.
